  • Please find an experienced ERISA attorney in your area immediately. Time is of the essence. Please check out this LTD Forum. They are very helpful with questions and you may even find a good attorney here. If you have doctors to back you up saying that you must have the surgery and not capable of working in any occupation right now, a good ERISA attorney will help get your LTD back.     PS it will not matter when the surgery was scheduled. this is all due to the original medical problem that has disabled you. Docs like to think that they know about these things but often do not.
  • Too much. I know that is easier said than done but I feel strongly that if your doctors are behind you it will be very easy for an ERISA attorney to get your benefits reinstated. The LTD company will try anything that they think that they could possibly get away with and they count on the people that will not fight them on it.
    One thing that I learned a long time ago is that no matter what life throws at you, it usually works itself out. You won't fall off the face of the earth.
