SSDI? Could I get it?

I have read some of the stories about disability! I am signed up and waiting to hear something. Hopefully it will go through but I am doubting my chances. I cannot work, I did for over 15 years and then the problems started. After my surgery I went back to work and well as you can see by my mri results below that it didnt work out to well for me. I came home everyday and went to sleep completely exhausted arms neck shoulders and everything else aching. Hands cramp up, cant lift or use my arms for extended periods of time, migraines, cant sit at a desk shoulders neck and arms would be on fire from all the inflammation and pain horrible horrible pain. The only reason I went back was my husband had to take medical leave which left us with limited income resources and now he is drawing his SSDI and my body has completely had it. It pains me to do laundry or even vac. I would love to hear from everyone who has dealt with this and knows what kind of problems if any i may be dealing with. Oh and Im 37 fell apart at 35. I would work if I could but I know my limits and this is it. Plus my employer wants my resignation. No way Im on std. if i quit i lose my money right.

stress
swelling from knees to feet
osteoporosis-t score of -3 really bad told not to even cough hard or i could break my back
muscle spasms
cant stand or sit for long periods
no lifting no anything basically
degenerative disc disease

And I may come across more of the drs paperwork tomorrow. Anyway she did do two papers for me saying no work ever again and that i needed to sign up on disability.

My employers main branch called me promptly the first working day after i submitted my medical leave papers. Suggested I resign and told me I could continue to draw my std since i was already signed up on it. I told them i would discuss this with the std company and then if they tell me the same thing i will call my lawyer and ask him. So then they send me a letter the same week and at the bottom in bold letters they are requesting that if i am unable to return to work i need to submit my resignation. UGH!! Then all the people i worked with start calling me and they have been told that i quit. MAN they just dont stop. I have a right to my std it was paid for during the years that i worked and if i resign i dont draw because its to replace my income and a resignation would dissolve that income and would then take away my std check in my opinion. i havent called the std company yet! Well I didnt file WC but you would think that im reaching in and taking money from my employers wallets. If they ask for my resignation one more time I will let my lawyer handle it. In our work policy we have a right to one year of leave without pay so i just dont know what they are so mad about. They have already replaced me they arent paying me so???

Hmmm....

I do not think that you would lose your STD if you resigned but I would not trust your employer. It must in some way benefit them if you resign or they would not be so persistent it seems. I think that the key to being successful in collecting SSDI will having your doctor behind you 100%. Have you talked to your doc at all about it? It may be wise to talk to him just to make sure that he will back you up. Good luck.

i agree with "C" you really need your doctor behind you 100% to get your disability rolling.. =D> that is all great for your employer to say but that is no determination for disability. it helps but nothing more.. good luck and move ahead as quickly as possible. smiley Jenny smiley

Hi

Agree with above, your doctor must be behind you 100 percent that you are disabled. Social security will ask that one of your doctors fills out a functional status. At your age, they may give you a harder time because they consider that you may be retrainable in another career. If you are denied, I would advise getting a disability lawyer. Have you checked out all the information on www.ssa.gov? Make sure you have all your medical records and review them for accuracy. Also, make sure you follow all of your doctor's recommendations for care. I wouldn't concern yourself too much about your employer. I don't believe they can force you to resign. But, SSDI will not consider you disabled if they feel you can return to work within a year.

She is behing me 100% even filled out paperwork the lawyer asked for. Just sitting here wishing I would have got some news today but alas nothing came.

Resigning

I think if you resign you will loose the std income. With STD income it basically says that you will get better and return to work. How long does your STD income last. Now if you have LTD that would be a bit different. I wouldn't make a move either way to you get legal counsel, but that is my opinion. Not sure what state you are in, but many states are Right to work state or employment at will state. Which basically says the employer can terminate your employment at any time, for any reason they see fit as long as it is not discrimination. If there is any type of discrimination going on here, keep in mind the statue of limitations starts running when the offense occured, not when and if they terminate. So them sending the letter would be the start date on the statue of limitations, if it were to be discrimination in away.

SSDI

STD goes into LTD after 6 months and I have already submitted paperwork stating i would be off for a year. Policy states that if you do not return to work within a year you must resign. I wont resign if I lose my only means of income. Once I turned in paper to be off for the year by policy they could hire a replacement and then if I were to return they would put me into a position equal to the pay i was receiving in my old position but maybe in a different building. I have no intention of returning but they dont know that. They have also hired a replacement and now i think they just do not have a position to put me in should i return. And they would still have to let me return at a higher pay status and most assuredly this is driving them crazy.
