Florida No Fault

Hello, my name is Amber and I am currently 22 years of age. Back in November of 2006, I was in a pretty bad car accident. I was driving my fiances 97 Cadillac on a highway at 40mph when a girl in a Hyundai Tiburon ran a stop sign, and I plowed right into her. Both cars were totaled, and I was taken to the hospital with a headache and bruises and cuts due to the airbags. Because of Florida No Fault, I am responsible for my own medical bills. Now, my insurance has paid it's due, but I have reached my PIP. I have no health insurance, no money, just graduated from college, and don't know what to do. I have been through 5 jobs because of my back, not able to keep them or they fire me right after I give them my limitation notes. No doctor will see me without insurance or unless I have the money straight up front. I am currently on an LOP with my local Chiropractor, but he can only do so much for me. When I was in the accident, I had several MRIs and X-rays. I have a severe disk herniated in my T7 Vertebrae, protruding into my spinal cavity/canal and putting pressure on my sciatica. I also now have scoliocis, 2 bulging disks on T6 and T5. I have 2 messed up ribs, and reverse curvature of the neck. I have had shots in my back, but those didn't help. I have tried to see a pain management doctor, but I had to pay up front and I just didn't have it. My chiro says that I will need surgery or I won't be able to have kids. These past two weeks however my back seems to have gone down hill. I have having numbness and tingling in my legs, sharp severe pains in the buttox and legs, sharp lower and mid back pain, muslce spasms in the neck, back, and legs. I have been in the most excruciating pain these last 3 days then ever before. I can no longer bathe myself, put my sneakers on, pretty much do anything without being in moderate to severe pain. I cannot even stand up straight because it feels like my bones are smashing my nerves up in a mortar. I am so depressed, have no money, and just do not know what to do. Everyone tells me to try to look into programs or experimental surgeries so I can get it done for free, but this is my back we are talking about. My life. I don't just want anyone to touch it. I can't even see another doctor to get other opinions. Anyone have any ideas? I am on hydrocodone and naproxen, and I barely take it because it knocks me out and I get stomach problems afterwards. Someone help me. I am so young....oh, and the girl that pulled out, she has no money but is driving around a new Nissan Extera....what gives? My fiance STILL has no car....thanks Florida No Fault!


  • I am so sorry to hear about all your problems at such a young age. My first thought is do you have a lawyer? You really need one. Your auto insurance should be doing more then they are. Since you are on no-fault, it is your insurance company who should be paying these bills. I also have no fault, in another state. You need to start fighting for YOU. Stand up for your rights, this has been going on a long time, Just remember everything has a time limit. I would get on the phone with your insurance and ask them what you need to do, to see another doctor and get some relief. Again, If you don't have a Lawyer, at least call a few in the telephone book, and find out your rights. The first visit is free in most states, and most you don't need to pay until you win your case. If you don't win, they get nothing. Where are your parents? If you just finished school could you not still be on their insurance? That may be a way for you to get some testing done and surgery if needed...

  • I'm so sorry for what you're going through right now... I sure an with Just me of what was said.... Please do go and get yourself a lawyer and he'll be helping you on what steps to take. I sure hope you're on your parents insurance too that might help you greatly.....
    I'm not familiar with Florida's no fault but unfortunately I know from friends that Florida's system,sorry to say, it stinks...
    1 1/2 yrs ago I had a car accident and it was totaled too and for almost a year I had to go through many doctors and I even had a crack on my tooth that I had to have it extracted and had an implant. I also had developed TMJ and I was going for treatment for almost 7 months all this was covered 100% through my no fault insurance.. I don't know how it goes in Florida but I was under the impression that all nf ins are the same everywhere in the US but I guess I'm wrong.

  • I agree with the others get a attorney. There is nothing that says you cannot move this to a civil court. Also something else to consider is you may want to register for grad school and through the college get insurance and get the medical care you need that way. You can then explain your situation to the dean and they will defer your classes but then you would be covered with out having a pre-existing condition as would happen buying insurance on the open market.
  • I agree with all, get legal advice. How old was this girl? If she was a minor her parents may be liable. Plus, with a civil judgement against her now there will be liens placed for years. So, if she gets an inheratence, wins the lotto whatever you have a judgement against her. But, there are time limits so you need to get on this one quick.
  • Thank you. I do have a lawyer, problem is, I have exhausted my PIP, so my insurance won't pay anymore. Parents? lol, I paid for schooling, and they don't even have health insurance of their own. They just have a life insurance on me just in case something happens to me. They bought a boat too, must be nice. My fiance is selling his motorcycle, his most reliable means of transportation to pay for my MRIs I need ASAP.

  • Thank you everyone! I have a lawyer, and I have a unique case he says. She is 18 and has no money, either does her parents. They have a house, but already have taken several mortgages out on it. I can't put a lean on her parents property and yes, I could take her to court. But, the issue with that is, I will have to claim bankruptcy because I just can't afford court, and I could force her to file bankruptcy, but my lawyer says that all I would get it a paper that says I won, but doesn't mean they have it. Their credit is also so bad, they can't even take out any loans. I just want to know how she is paying for school, she works a great job, and has a new car! My fiance is practically walking to work now....ugh. All my doctors told me to apply for medicaide. I got denied. Because I am onnly 72% disabled, not 100%. Or, I have to be a non-US citizen. WHAT KIND OF BULLCRAP IS THAT? Why can a non american get health insurance, but an American who pays her taxes and pays for the medicaide, can't even get it!?
  • do you have one near you? These are often the best hospitals and they will set up payments with you and charge according to your income. Even if you have to drive a little it would be well worth it!
