Since I have received my second denial and am trying to find a lawyer to represent me, should I go ahead an file an appeal on my own? Or wait until I find a lawyer?? I received my last denial on Dec. 28, so I'm down to only about one more month to appeal. I just assumed I should wait until i find a lawyer, but since that seems to be impossible for me, I'm thinking I should atleast file the appeal by myself??

  • First off, sorry you were denied...

Secondly, the appeals are processed in a "date received" order, so the sooner you get your paper work in, the better.

Since it will take a while before your case is assigned to a judge, you will have time to look for your attorney. But don't wait too long (I can remember clients calling the attorney I worked for days before their hearing.... then it would have to be postponed so the attorney could review, request records, etc)

Ok. I said all that to say, No, don't wait... file your appeal now.

    Best of luck to you!
  • Thank you. I had just assumed that I needed the lawyer to file the appeal. It just dawned on me today that I could probably do it myself. Can I do it online?? I guess I need to find the denial letter and figure out what to do next. Thank you again!
