I got in an accident with an 18wheeler

Well here it goes the story of my life ive been dealing with back pain for over 8 years and had 1 surgery done in 2007.

In 2007 of June I got a Herniated Disc which bulged out and pinched my nerve which cause my to have severe pain from the buttocks down to the right leg. So I went on with the procedure of getting a surgery done on L1 and L2 from what I remember and after 6 months later I was back in shape normal again Felt good as new but than after 4 years later i felt a little mild pain after a massage so I went to my primary M.D. to tell him about the situation so he provided me with nerve and pain medication for about a year or two now and now on to the worse part.
I got rear ended by an 18 wheeler on May 28th, 2013 which shook my whole body apart i felt the pain strike down my right leg and back so bad i could not even move my right leg without feeling the pain that was worse than the pain i had back in 2007.

First of all I called my insurance company to let them know the situation and the thing is I just bought that little tacoma not even a month old. Should the 18 wheeler be liable for the damage he has caused? The pain I was having before the 18 wheeler was not chronic it was from time to time when I would stand around and not move after the accident I can barely move at all and I cant stand this pain I dont want to suffer like I did back in in 2007 im only 25 and just barely had a daughter.

Whats a good way to handle this kind of situation?
Should the 18 wheeler be liable for this accident?
The loss of my job?
Maybe disable for the rest of my life?
Loss of finance and im in the circumstances of getting kicked out of my place.
My wife does not work shes part time since she has to take care of my daughter.
I also had an anxiety attack 5 days after the accident due to stress dont know what to do so young and living check by check.
I have never been stressed like this every in my life.
What is going to happen in this kind of situation?

Forget to mention that the 18 wheeler was fully loaded and from what i remember in the rear view mirror I saw him reaching for something or not paying attention to the light and struck me from behind and nearly got me in another accident which would of T boned me and caused me my life. Thank God!

I am freightend by big trucks im freightened to leave the house Im starting to have awkward things happening to me after the accidents i.e. bad dreams trucks accidents financial debt death no where to live etc.

bottome line

What should I do?

I wake up every morning with nerve pain and muscle spasms and worst of all I cant even sleep with my wife.
I also had a Anxiety Attack 5 days later after the incident and i went to the ER thinking it was a heart attack


  • After a major accident it's normal to get Post Traumatic Stress disorder, Look it up on the web and follow what they say. Blogging here is good, to get over it you need talk about it as much as you can to anyone you can.

    I am in Australia and we have compulsory third party insurance, so here you would be covered. You do need to see a lawyer as soon as you can NOW - even if you are in pain. One who specialises in accident claims. They usually work for nothing, and get part of the payout if you win. Be careful though, if you don't win you can be liable for the other person's costs. I didn't see a lawyer straight away which cost me everything. I though I would get better - long story but you do need to see a lawyer no matter how much pain you are in.. Make sure you are told of their fee structure though so you know what to expect.

    There is lots of support for people with PTSD - lots of soldiers have it and the services are usually free. The guys I saw who did the best were the ones who discussed everything with their wives. You don't know when it's going to happen so you do need to get over it or you could end fearing leaving the house. It's pretty scary stuff - I had it so I know but I got over mine by blabbing to everyone and it went away and has never come back. Please see a lawyer - it's the biggest mistake I ever made not seeing one.

  • Coverage depends on where you live. If you are in the US then some states have what is called no-fault insurance and someone will pay. Some states are at-risk which means there is usually very little insurance. Best thing to do is call your insurance company. Generally you deal with your own company and they will go to the other company to get back what they are owed.

    You should also contact a lawyer. If the truck was a reputable company they should have good insurance. Being hit from behind makes it all his fault. However today often there are multiple layers involved in trucking. The driver, a leasing company, the shipper, even the company they are delivering to. So it can be difficult to sort out the responsible parties. Just don't go to the first lawyer you see on late night TV. Often they want to settle immediately for a quick buck.

    I'm assuming you are seeing a bunch of doctors. Tell them about your dreams and your fears. There are psychologists who deal specifically with accidents like this. So the sooner you get some help the better.
  • Thank you so much you guys really helpful I have chronic pain and I thought it was just me.

    Like I said though i'm not in it for the money, I just want to see my family and grow old. Than again I dont want to be living a horrible life with debts owed to medical.
    They said they are not totaling the vehicle and fixing it I wonder if I still have to pay for the vehicle since im not working and just at home blogging.
